Billing Policies

This is the web site of PredictWind Limited ("PredictWind", "we", "us").

General

By using PredictWind's services, you agree to comply with this website policy and with any supplementary policies which PredictWind may post on the web site from time to time. PredictWind may change its policies at any time by changing or removing existing terms or adding new ones. We will tell you about any changes by posting an updated version of the particular policy on the web site, and any changes will take effect immediately once they are posted on our web site. It is your responsibility to check this and any other policy regularly for any modifications or updates. Your continued use of our services after any changes have been posted on our web site indicates your acceptance of those changes.

Billing and Refunds

We offer a subscription-based service or alternatively you can use our "Free Version" with no cost or obligation.

You may select from 4 different options:

1. Free Version.  You can use the free version of PredictWind with no cost, obligation or time limit.
2. 3, 7 or 21 non-consecutive days' use of the service. A day is defined as a 24hour period starting at midnight, in the timezone selected by the user. Under this option, you will pay in advance for 3/7/21 days' use of the service and we will keep a record of each day on which your User Identification is used to access the PredictWind services. After making payment you can access the forecast site, and this will not be counted as the first day, but a free test of the service. After this test, you may access the services as many times as you wish to on each day of use. Once you have finished the 3/7/21 days, we will give you the option to continue the same package/days usage, change to a different package/billing option, or cancel the service and use our free service. 
3. 3 Months. Under this option, you will be billed 3 months in advance to access the services on as many days and as many times as you wish during this 3 month period. Once you have finished the 3 month period, we will give you the option to continue with another 3 months, change to a different package/billing option, or cancel the service and use our free service. 
4. 1 Year. Under this option, you will be billed each year in advance to access the services on as many days and as many times as you wish during that year. Once you have finished the year service, we will give you the option to continue with another year, change to a different package/billing option, or cancel the service and use our free service. 

You may change your billing option at any time. The new billing option will take effect immediately. Refunds will be given to customers with monthly/yearly subscriptions based on the amount used for the month/year. In this instance a refund will be credited to your next purchase, but not exceeding the amount of the new purchase.

We offer four service levels; Free, Basic, Standard and Professional. Descriptions of each of the service levels and the information and services that each comprises are set out in the relevant section of the PredictWind website. The billing charges for each service level are set out in the pricing page of the PredictWind website.
 

Privacy

We don't collect domain or email information from casual visitors to our web site.

We collect the e-mail addresses of those who communicate with us via e-mail and information volunteered by the consumer, such as survey information and/or site registrations, name and address, payment information (e.g., credit card number and billing address). We process credit card payments through a third-party processor. We do not store any credit card information on our server.

We use cookies to store visitors' preferences and record session information, such as what pages within the website you visit, in order to determine what services and websites are the most popular. We also use cookies to keep you logged into the site.

If you do not want to receive e-mail from us in the future, please let us know by emailing us at support@predictwind.com.

Information we hold about you or your use of the PredictWind website may, and in the case of a Commercial User will, be disclosed to the Commonwealth Scientific and Industrial Research Organisation ("CSIRO") under the terms of our Licence Agreement with CSIRO. If you would like further details on what information we may be required to disclose to CSIRO, please contact us at the addresses above. We do not share your details with advertisers or any other third-party. We do not have advertising on our site. We may disclose information about you or your use of the PredictWind web site and/or services without your prior permission if we have a good faith belief that such action is necessary to:

1. conform to legal requirements (including, but not limited to, requirements in accordance with applicable laws, regulations or government request) or comply with legal process, or to help maintain the law;
2. facilitate the sale or other disposition of a business as a going concern;
3. for the protection of the public revenue.

Upon request we provide site visitors with access to their own financial information (e.g. credit card account information), transaction information (e.g. dates on which customers were billed for subscription fees) and contact information (e.g. name, address, phone number) that we maintain about them which is readily retrievable. We may charge you for any reasonable costs incurred in retrieving and providing such information. You can request access to this information by e-mailing us at the above address. Upon request we offer visitors the ability to have inaccuracies corrected in contact information, financial information and unique identifiers. You can have this information corrected by sending us e-mail at the above address. Personal information collected in respect of your use of the website and services may be stored and processed in New Zealand or in any other country in which PredictWind or its related companies or agents maintain facilities. By using our services, you consent to such personal information being transferred outside of your home country.

Security

When we transfer and receive certain types of sensitive information such as financial information, we redirect visitors to a secure server and will notify visitors before they are transferred to the secure server.

Governing Law

This policy shall be governed and construed by the laws of New Zealand and you accept that any dispute will be dealt with under the laws of New Zealand and through the New Zealand courts.
